NOTICE REGARDING INSURANCE TRACING REQUESTS
FEES & BILLING
Terms of Business
∙NET 15 days from the date RFR returns results via the JIRA Client Portal or email, and
delivers the invoice via the JIRA Client Portal or email from QuickBooks.
∙15-day grace period; late fee of $25 after grace period.
∙Additional 15% late fee every 30 days thereafter, calculated on the invoice total plus any
prior late fees previously assessed.
∙Services may be suspended and the payment method on file charged without further
notice, with the charge calculated on the invoice total plus any prior late fees previously
assessed.
∙All approved clients must maintain a valid payment method on file.
Fees Quoted
∙“Per policy researched.” Applies even if the policy or self-insurer fails to provide
coverage.
∙Only an inconclusive result or “no-hit” is No-Fee.
Exceptions to the Fee Schedule
∙May apply for lengthy research (e.g., older cases). Additional charges will be approved in
writing before work begins.
Incomplete or Inaccurate Information
∙Additional fees may apply if incomplete or inaccurate information is provided.
No Charge Policy
∙No fee if RFR cannot identify policy limits or confirm lack of coverage.
Partial Information
∙If only part of the requested information is found, only that portion is billed.
Turnaround Times
∙Standard: 5–7 business days for liability limit traces (target only, not guaranteed).
∙Delays do not entitle Customer to withhold payment unless RFR agrees in writing to
waive fees.
Rush Cases
∙Placed ahead of non-rush cases.
∙Rush fee waived if results not obtained or research exceeds 5 business days.
∙3-Day, 1-Day, and 3-Hour rush cases cannot be canceled.
∙Rush fees remain payable in full under NET 15 terms.
Policy Existence Cases
∙Cannot be canceled once submitted.
∙$270 No Hit Fee ($375 for commercial) applies regardless of outcome.
∙Failure to disclose known policies waives any right to dispute results or fees.
∙Policies in police reports count as valid hits unless RFR is instructed otherwise in writing.
Termination
∙$50 fee for termination or changes after request submission.
∙All changes must be in writing; verbal requests not accepted.
Dispute of Fees
∙Must be submitted within 90 days from invoice date; no exceptions after.
DEFINITIONS
∙Insurer: Carrier, Agent, Broker, or Defendant found to be Self-Insured.
∙Date of Loss: As stated on Request Form, or any date within provided loss period.
∙Policy Existence / Identifying the Insurer: Providing the Insurer name for the named
Defendant on loss date.
∙Termination: Cancellation after request is received.
∙Liability Limits: Returned for policy number provided or associated with claim number
for date of loss; no guarantee regarding excluded/non-permitted drivers.
PROCESS
∙Requests: Submit via JIRA Client Portal or as directed by RFR. Submit each request
only once. Duplicate submissions are billed individually.
∙Policy Existence Searches: Subject called “Defendant” on order form; may or may not
cover subject vehicle/property.
∙Successful Hit: Subject is policyholder or named driver on located policy.
∙Additional Searches: Only conducted on separate requests.
∙Turnaround: 5–7 days for policy limit requests; 7–10 for policy existence requests
(target only, not guaranteed). Expedited services available.
∙Policy Limit Traces: Must include policy/claim number and any insurer correspondence.
LIABILITY & LEGAL PROTECTIONS
Disclaimer
∙RFR’s results are for informational purposes only and do not constitute legal advice.
∙Data is sourced from third parties and may be inaccurate or incomplete.
∙Services provided “as-is” and “as-available.”
∙Customer’s sole remedy is a refund of fees paid for the specific service in question.
No Incidental or Consequential Damages
∙RFR is not liable for any indirect, incidental, consequential, punitive, or statutory
damages, including lost profits or opportunities.
Indemnification
∙Customer will indemnify RFR, its affiliates, contractors, vendors, and information
providers for claims arising from breach, misuse, or inaccurate information provided.
Confidentiality
∙Customer must keep RFR’s proprietary methods, processes, pricing, and communications
confidential.
Force Majeure
∙RFR is not liable for delays caused by events beyond its control (e.g., natural disasters,
government actions, internet outages, strikes).
GOVERNING LAW
∙Governed by the laws of Idaho.
∙Venue: Ada County, Idaho. Parties waive objections to jurisdiction.
AFFIRMATIONS & DECLARATIONS
∙Customer will only use services for lawful purposes.
∙Customer is responsible for compliance with all laws when using RFR’s information.
AMENDMENT CLAUSE
∙RFR may update these Terms & Conditions at any time without notice.
∙The most current version posted on RFR’s website or client portal supersedes prior
versions.
∙Continued use of services = acceptance of current Terms.
ENTIRE AGREEMENT
∙These Terms & Conditions, the Request Form, and Fee Schedule constitute the entire
agreement between RFR and the Customer, superseding all prior understandings.
